TypeShot Terms of Service

These Terms of Service (hereinafter "Terms") set forth the conditions of use for the application "TypeShot" (hereinafter "the App"), developed by Takao Sunagawa (hereinafter "the Developer") for iOS/iPadOS, and all related websites and services (hereinafter collectively "the Service"). All users of the Service (hereinafter "Users") agree to these Terms before using the Service.

Article 1 (Definitions)

1. "The App" means the iOS/iPadOS application "TypeShot" distributed by the Developer through the Apple App Store.
2. "The Service" means all services provided by the Developer in connection with the App, including this official website.
3. "User" means any individual who downloads the App or uses the Service.
4. "User Content" means photos, collages, layered typography graphics, social media posts, and design data created by a User using the App.
5. "App Assets" means templates, graphic elements, frames, fonts, and sample materials bundled with or provided through the App.
6. "Paid Service" means the additional features and content unlocked via the "TypeShot Pro" subscription or one-time lifetime purchase.
7. "Project" means an editing package created and saved by a User within the App.

Article 2 (Agreement to Terms)

1. Users agree to these Terms upon downloading the App or accessing the Service website.
2. If you do not agree to these Terms, you may not download or use the App.
3. Minors must obtain the consent of a parent or legal guardian before using the Service.

Article 3 (Scope of License)

1. The Developer grants Users a non-exclusive, non-transferable, non-sublicensable license to use the App in accordance with these Terms.
2. The App requires compatible devices running iOS 17 / iPadOS 17 or later.
3. Users may use the App for both personal and commercial purposes, provided such use complies with these Terms.

Article 4 (Intellectual Property and Rights)

4.1 App and Asset Rights

1. All intellectual property rights in the App (source code, design, UI, documentation, and App Assets) belong to the Developer or respective licensors.
2. Bundled fonts are open-source fonts licensed under the SIL Open Font License (OFL) or compatible open licenses. Full attribution and license details can be viewed in Settings > Licenses within the App.

4.2 User Content Rights & Warranties

1. Copyright in User Content created by Users belongs to the respective User.
2. Users may freely use, share, publish, and monetize their User Content for personal and commercial purposes.
3. User Representation & Warranty: Users represent and warrant that imported photos and images do not infringe on third-party copyrights, trademark rights, right of publicity, or privacy rights.
4. The Developer claims no ownership or rights over User Content and will never use User Content without explicit permission.

Article 5 (Free Plan, Paid Service "TypeShot Pro", and In-App Purchases)

5.1 Comparison Between Free Plan and TypeShot Pro

The App allows users to explore core design features—such as photo importing, automated subject cutout, text and layer editing—free of charge. Exporting finished designs (PNG/JPG) that do not contain Pro fonts is completely free of charge. Exporting designs containing Pro fonts is exclusively available with "TypeShot Pro" (exported images never contain any watermark). Key feature differences are outlined below:

5.2 Plans and In-App Purchases

5.3 Payments, Auto-Renewal, and Cancellation

1. All purchases are processed securely through Apple's App Store (StoreKit).
2. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
3. Manage or cancel subscriptions in iOS Settings > [Your Apple ID] > Subscriptions. Deleting the App does not automatically cancel subscriptions.

5.4 Restoring Purchases & Refunds

1. To restore purchases after reinstalling or switching devices, use "Restore Purchases" in the App Settings.
2. Refunds are subject to Apple's policies and must be requested through Apple Support.

Article 6 (Data Storage and Local Processing)

1. Projects, photos, and edits are stored entirely on the User's local device. The Developer does not store, access, or sync your photos on external servers.
2. Users are encouraged to back up important photos and exported images regularly (Note: Exporting designs containing Pro fonts requires TypeShot Pro).

Article 7 (Prohibited Conduct)

Users may not:

1. Extract and redistribute or resell bundled fonts and assets.
2. Create or publish images that infringe on third-party copyrights, portraits, or privacy rights.
3. Create or publish unlawful, defamatory, obscene, or offensive material.
4. Reverse engineer, decompile, or disassemble the App.

Article 8 (Disclaimers and Governing Law)

1. The Service is provided "AS IS" without warranties of any kind. The Developer is not liable for disputes arising between Users and third parties regarding photo rights.
2. These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
